Vu la requête, enregistrée au secrétariat du Contentieux du Conseil d'Etat le 14 décembre 1988, présentée par Mme Anna X..., secrétaire général du syndicat de communes pour le personnel communal des Vosges, demeurant "le Séréna", ... ; Mme X... demande au Conseil d'Etat :
1°) d'annuler le jugement en date du 8 novembre 1988 par lequel le tribunal administratif de Nancy a rejeté sa demande dirigée contre la décision verbale par laquelle le président du syndicat de communes pour le personnel communal des Vosges a refusé de la rémunérer par référence à l'échelle indiciaire de secrétaire général des communes de 20 000 à 40 000 habitants ;
2°) d'annuler pour excès de pouvoir cette décision ;
Vu les autres pièces du dossier ;
Vu le code des communes ;
Vu le code des tribunaux administratifs et des cours administratives d'appel ;
Vu l'ordonnance n° 45-1708 du 31 juillet 1945, le décret n° 53-934 du 30 septembre 1953 et la loi n° 87-1127 du 31 décembre 1987 ;
Après avoir entendu en audience publique :
- le rapport de M. Turquet de Beauregard, Conseiller d'Etat,
- les conclusions de M. Fratacci, Commissaire du gouvernement ;
Sur la régularité du jugement attaqué :
Considérant qu'il résulte des pièces du dossier que, conformément aux dispositions des articles R. 108 et R. 162 du code des tribunaux administratifs et des cours administratives d'appel, le greffe du tribunal administratif de Nancy a notifié, par lettre recommandée, à Mme X..., le 20 septembre 1988, la date de l'audience à laquelle son affaire était inscrite ; que cette correspondance a été présentée le 23 septembre 1988 à l'adresse que Mme X... avait indiquée sur sa demande ; que le préposé a déposé le même jour l'avis prévenant la destinataire, alors absente, que le pli était tenu à sa disposition ; que faute d'avoir été réclamée, l'enveloppe a été retournée par l'administration des postes au greffe du tribunal ; que par suite, Mme X..., à qui il appartenait...
