REQUETE du sieur X..., tendant à l'annulation d'un jugement du 28 novembre 1965 par lequel le Tribunal administratif de Montpellier a rejeté sa demande tendant à l'annulation de la décision du ministre de l'Intérieur du 24 avril 1963 refusant de lui reconnaître droit à une pension de retraite ;
Vu l'ordonnance du 15 juin 1945 ; le Code des pensions civiles et militaires de retraite ; l'ordonnance du 31 juillet 1945 et le décret du 30 septembre 1953 ; le Code général des l'impôts ;
Considérant qu'aux termes de l'article L. 15 du Code des pensions civiles et militaires de retraite alors en vigueur, "le temps passé dans toute position ne comportant pas l'accomplissement de services effectifs ne peut entrer en compte dans la constitution du droit à pension sauf... dans les cas exceptionnels prévus par une loi ou déterminés par un règlement d'administration publique" ;
Considérant que si l'article L. 97 du code précité, reprenant la disposition correspondante de l'article 4 du titre II de l'ordonnance du 15 juin 1945, prévoit que "la période pendant laquelle les fonctionnaires et agents ont été mis dans l'impossibilité d'exercer leurs fonctions en raison de l'une des situations énumérées à l'article 2 de l'ordonnance du 15 juin 1945, complétée par la loi du 19 mai 1948, entre en compte pour la constitution du droit à pension et pour la liquidation", cette disposition vise uniquement les personnes qui, ayant déjà la qualité de fonctionnaires ou agents publics, ont été mis dans l'impossibilité d'exercer leurs fonctions du fait des événements de guerre et n'est pas par suite applicable aux personnes qui, comme le sieur X..., ont été empêchée par ces mêmes événements d'accéder aux services publics et dont la situation a été réglée par les titres III et IV de l'ordonnance du 15 juin 1945 ;
