Vu la requête sommaire et le mémoire complémentaire, enregistrés les 25 août 1992 et 12 octobre 1992 au secrétariat du Contentieux du Conseil d'Etat, présentés par M. François X..., magistrat, demeurant ... ; M. X... demande l'annulation pour excès de pouvoir de la décision du ministre de la justice en date du 27 mai 1992 lui refusant le bénéfice d'indemnités de déplacement auxquelles il prétend en application de l'article 5 du décret n° 90-437 du 28 mai 1990 ;

Vu l'ordonnance n° 45-1708 du 31 juillet 1945, le décret n° 53-934 du 30 septembre 1953 et la loi n° 87-1127 du 31 décembre 1987 ;
Après avoir entendu en audience publique :
- le rapport de M. Dupuch, Conseiller d'Etat,
- les conclusions de M. Sanson, Commissaire du gouvernement ;
Considérant qu'aux termes de l'article 5 du décret n° 90-437 du 28 mai 1990 fixant les conditions et les modalités de règlement des frais occasionnés par les déplacements des personnels civils sur le territoire métropolitain de la France, applicable, en vertu de son article 4, aux magistrats : "L'agent appelé à se déplacer pour les besoins du service hors de sa résidence administrative et hors de sa résidence familiale peut prétendre à la prise en charge de ses frais de transport ... et au paiement d'indemnités journalières destinées à rembourser forfaitairement ses frais supplémentaires de nourriture et de logement" ;
Considérant que pour refuser, par décision du 27 mai 1992, le bénéfice de ces dispositions à M. X..., magistrat "placé" auprès du premier président de la cour d'appel de Colmar mais exerçant ses fonctions au tribunal de grande instance de Strasbourg, le ministre de la justice soutient que l'intéressé a établi sa résidence familiale dans la commune...
